Latest Jersey Governor Phil Murphy on Wednesday said yes consider opposing Supreme Court and proceed to supply mifepristone if the court decides in favor of banning the abortion pill.
Asked if the state would prescribe mifepristone after such a ruling, Murphy said MSNBC: “To find out.”
“After I say it’s all on the table, Katy, I mean it. This motion overall, be it mifepristone, be it North Carolina, South Carolina or Florida in six weeks,” he said in an interview with MSNBC’s Katy Tur, also referring to other state-level abortion restrictions.
“It will cost people lives. It will cost their health, it will also cost people’s lives, especially women, unfortunately. That is the point, we’re going to do whatever it takes to save lives,” Murphy, a Democrat, said.
Murphy’s remarks got here after the U.S. fifth Circuit Court of Appeals in Latest Orleans heard arguments in a case that would force mifepristone off the market nationwide, including states where abortion is legal.
The case hinges on whether the Food and Drug Administration’s approval of the abortion pill must be revoked.
The closely watched legal fight is probably going to find yourself again in the Supreme Court, which already intervened last month to keep the drug available as the case plows through the court system.
Whilst the supreme court rules in favor of banning mifepristone, Judge Samuel Alito has suggested that the FDA may refuse to implement it.
Alito said in an objection last month that the FDA could use its enforcement leeway during the litigation and permit Danco Laboratories, the maker of mifepristone, to proceed distributing the abortion pill.
Mifepristone, used together with one other drug, misoprostol, accounts for about half of all abortions in the country.
